Portal terms for agencies

1. Licence to use listing content

You grant BidAI a non-exclusive, royalty-free, worldwide licence to reproduce, cache, resize, crop, format and publish the listing content you send, including text, photographs, floor plans, video links and agent details, on bidai.com.au and in related search, sitemap and preview services. The licence covers the campaign for each listing and a reasonable period afterwards for results, and ends when the listing is withdrawn or deleted or you ask us to remove it. BidAI may sub-license the content only to service providers that host or deliver the site for us.

2. Your warranties

For every listing you send, you warrant that:

• you hold a current agency agreement with the vendor and are authorised to advertise the property, including on third-party portals;
• you have the vendor’s consent to publish the listing, its address and its photographs;
• you own, or are licensed by the photographer, videographer or floor-plan creator to use and sub-license, all images and media, and that licence extends to third-party portals such as BidAI;
• the listing complies with applicable laws, including consumer law and state rules on price representations and underquoting; and
• agent names and contact details you include are provided with the agents’ knowledge, for buyer enquiries about the listing.

3. Accuracy and updates

You’re responsible for the accuracy of listings. Your CRM sends the full listing every time it changes, and the most recent version replaces earlier ones. Withdrawn, off-market and deleted listings are removed from public view when we receive them.

4. Takedown process

You, the vendor, or a rights holder can ask us to remove or correct a listing or an image. Reply to any BidAI email or use the contact details we provide with your feed confirmation, and include the listing address or BidAI URL. We aim to remove disputed content within one business day of a valid request and to delete cached images within 24 hours. We may also remove any listing at our discretion.

5. Attribution

We display your agency name, the listing agents supplied in the feed, and a link to your own listing page where one is provided. We don’t present your listings as BidAI’s own.

6. Privacy

Agent names and business contact details are used only to show who is selling the listing and to pass on buyer enquiries. Buyer enquiries are passed to the listing agent with the buyer’s consent, and you must handle them in line with the Australian Privacy Principles where they apply to you. We don’t sell or use agent or vendor details for marketing, and we delete listing data when a listing ends. See our privacy policy.

7. Approval, suspension and fees

We review each agency before its listings appear and may suspend a feed that breaches these terms. Listing is free during the launch period. We’ll give you at least 30 days’ notice before introducing any fees.

8. Liability

To the extent permitted by law, you indemnify BidAI against claims arising from content you supply, including copyright and consumer-law claims, and BidAI’s liability to you is limited to resupplying the service. Nothing in these terms excludes rights under the Australian Consumer Law that can’t be excluded.
